These Terms & Conditions constitute a legally binding agreement between you (the “Customer” or “User”) and El Macho (a brand owned by Three Shadows Cosmetics LLP). By accessing or using this website, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our website.

2. Eligibility & Account Usage

  • Age Requirement: By using this site, you represent that you are at least the age of majority in your state or province of residence (18 years in India).

  • Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login details and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

  • Accuracy: You agree to provide current, complete, and accurate purchase and account information. We are not responsible for delivery issues caused by incorrect addresses provided by the user.

3. Product Information & Disclaimer

  • Artisanal Nature: All El Macho perfumes undergo rigorous quality checks before dispatch. Due to the artisanal nature of our products, slight variations in fragrance strength, color, or packaging may occur between batches. These variations verify the handmade nature of the product and do not indicate a defect.

  • Medical Disclaimer: We are not responsible for any allergic reactions or skin sensitivities. It is the customer’s responsibility to check the ingredients list or conduct a patch test on a small area of skin before full use.

  • Visual Representation: We have made every effort to display the colors and images of our products accurately. However, we cannot guarantee that your computer monitor’s display of any color will be accurate.

4. Pricing, Payments & GST

  • Pricing: All prices listed are in Indian Rupees (INR) and are inclusive of Goods and Service Tax (GST) unless stated otherwise.

  • Price Changes: Prices for our products are subject to change without notice.

  • Right to Refuse: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

5. Shipping & Delivery

  • Timelines: Estimated delivery times are provided for convenience only and are not guaranteed. We are not liable for delays caused by third-party courier services or force majeure events.

  • Risk of Loss: All items purchased from El Macho are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

  • Defects vs. Variations: As per Section 3 (Artisanal Nature), returns will not be accepted solely based on minor batch variations unless the product is damaged or significantly defective.

  • All matters relating to returns, refunds, replacements, and cancellations shall be governed solely by our Return & Refund Policy

All content included on this site, such as text, graphics, logos, branding, images, audio clips, digital downloads, and design elements, is the property of El Macho and Three Shadows Cosmetics LLP. Unauthorized use, reproduction, modification, or distribution is strictly prohibited.

  • Any other matter relating to the service.

You agree to indemnify, defend, and hold harmless El Macho and our partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

These Terms & Conditions are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services. We may also terminate this agreement at any time without notice if you fail to comply with any term or provision of these Terms.

12. Governing Law & Jurisdiction

These Terms & Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India.

 

All disputes are subject to the exclusive jurisdiction of the courts in Aligarh, Uttar Pradesh.

Grievance Redressal Mechanism: In compliance with the Consumer Protection (E-Commerce) Rules, 2020:

  • Resolution Time: We aim to resolve all grievances within 30 days.

14. Limited-time Promotional Offer

  • Free perfume offer valid only for the first 100 successful orders. Subject to availability. El Macho reserves the right to modify or withdraw the offer at any time

15. Miscellaneous

  • Severability: If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.
